Gujarat High Court examines the boundaries of judicial propriety

The Gujarat High Court has upheld the dismissal of a judicial officer in a disciplinary matter involving the acceptance and use of a mobile phone allegedly provided by a practising advocate.

The case involved allegations concerning the use of multiple mobile phones/SIM cards and communication between the judicial officer and a practising advocate.

🔹 One of the mobile numbers was registered in the name of a practising advocate.

🔹 The disciplinary proceedings recorded substantial communication between the officer and the advocate.

🔹 The Court considered the circumstances surrounding the phone, its use and the relationship between the judicial officer and the advocate.

🔹 Significantly, the disciplinary authorities did not establish that the phone was being used for receiving bribes from litigants.

Nevertheless, the Court upheld the disciplinary action, emphasising the importance of maintaining professional distance, judicial propriety and public confidence in the independence and impartiality of the judiciary.
